Welcome to Maad (“we”, “us”, or “our”). By accessing or using our data collection platform (“Platform”), you (“User” or “Customer”) agree to comply with and be bound by the following terms and conditions (“Terms”). If you do not agree to these Terms, you should not use the Platform.

1.2. « data » refers to any information collected, processed, or stored by the Platform.
1.3. « User » refers to businesses, entities, or individuals who have an account on the Platform.

4.3. Data Security: We employ reasonable measures to protect data from unauthorized access, disclosure, or alteration. However, we cannot guarantee the absolute security of the data.
5. Subscription and Payment
5.1. Subscription Plans: Access to the Platform is subject to subscription fees as outlined in your subscription plan.
5.2. Billing: Users agree to provide accurate payment information and authorize us to charge applicable fees to their selected payment method.
5.3. Non-Payment: If payment is not received by the due date, we reserve the right to suspend or terminate your access to the Platform.
6. Intellectual Property
6.1. Ownership: All intellectual property rights in and to the Platform, including but not limited to software, trademarks, and logos, remain with Maad.
6.2. License: We grant Users a non-exclusive, non-transferable, revocable license to access and use the Platform solely for business purposes in accordance with these Terms.
7. Termination
7.1. Termination by user: You may terminate your account at any time by contacting us or through the account settings page.
7.2. Termination by us: We reserve the right to suspend or terminate your account if you violate these Terms or engage in unlawful or prohibited activities.
7.3. effect of Termination: Upon termination, your right to access and use the Platform will cease immediately. Any outstanding fees or charges incurred prior to termination remain your responsibility.
8. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental, or consequential damages arising out of or related to the use of the Platform, including but not limited to lost profits, data loss, or business interruptions.
9. Indemnification
You agree to indemnify and hold harmless Maad, its affiliates, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Platform or your violation of these Terms.
10. Dispute Resolution
10.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Delaware in the United States.
10.2. Arbitration: Any disputes arising under these Terms shall be resolved through binding arbitration in Dakar, Senegal, in accordance with the applicable laws of Senegal.
11. Miscellaneous
11.1. Entire Agreement: These Terms constitute the entire agreement between the parties concerning the Platform and supersede any prior agreements.
11.2. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
11.3. No Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
